Supreme Court Unhappy On NEET Postponement

Earlier The Medical Council of India (MCI) has filed an affidavit in Supreme Court stating it can’t go ahead with NEET UG next year; citing reasons as indifference with majority of states (AP, Karnataka, West Bengal, Tamilnadu, Maharashtra etc).

A Bench of Justices H.L. Dattu and C.K. Prasad after reviewing the petition has reportedly expressed dissatisfaction on postponing NEET UG. The apex court has questioned the petitioners as why they are backing the decision having sought permission to conduct common medical entrance test months ago. The court wasn’t keen to support the petitioners and said we are not part with the decision, ‘you can do what ever you want’.

The court didn’t pass any order and insisted the petitioners to with draw it’s application; the court indicated not to intervene ‘SC’ in this regard.

NEET UG is postponed to next year; MCI will face the challenge of convincing these opposing states for next year’s NEET UG. Though few states have agreed to participate from 2013; certain states (Andhra Pradesh) are asking for a 2 years exception. The whole story might again come up, what are your views!

    • If NEET is implemented in such a haste , only coaching centers will make lot of money.Again only the rich will be benefited.
      For the sake of the bright and poor students , who can not afford any costly coaching classes, CBSE AIPMT , other state PMT etc should continue for the timebeing.this will defenitely assist the bright students from poor families in the villages , who were preparing for this type of exams for the last many years without the assistance of the expensive coaching classes.

      CBSE, MCI, & the Govt should introduce NEET with proper preparations after a couple of years which will be helpful to the complte student community whether rich or poor , cbse or stateboard,urban or village, english or vernacular etc. etc.

    Amendment to pave way for holding NEET from 2013

    Determined to postpone the National Eligibility-cum-Entrance Test (NEET) 2012 for medical graduates by a year, the Health Ministry is seeking amendment to a notification that would legally pave way for holding the test from 2013.

    The move comes in the wake of the Supreme Court’s recent refusal to accept its demand to defer conducting of the NEET, scheduled for May 13, 2012 for the next academic session of 2013-14.

    “Since the apex court has refused to intervene in the matter, now we have no option but to amend the notification (dated December 21, 2010) to postpone the examination date for May 2013. The Medical Council of India (MCI) has already sent a proposal in this regard to the Health Ministry for its approval,” sources told The Pioneer.

    However, the case has brought to the fore the ineffectiveness of the present Board of Governors (BOG) of the MCI, headed by Dr KK Talwar, which remained a mute spectator in the whole episode. In fact, it acted as desired by the Health Ministry, which was opposed to NEET from the day it was conceived in 2010 by the MCI BOG led by Dr SK Sarin.

    Sources said, the current BOG could have appealed the Court to allow it to hold the NEET in the non-objecting states. “The CBSE was ready to hold the examination. Conducting it in some states would have given the Council an idea about the logistics as well as its efficacy.”

    Last year, the MCI had submitted before the court that the notification had been approved by the Centre as early as in August 2010, a claim contested by the Health Ministry.

    Clearly under pressure from the Ministry, the MCI made a U-turn in the court recently saying that with many States such as Goa and Maharashtra opposing the national-level common entrance test at under-graduate and post graduate levels, it is not in a position to implement it from 2012-13.

  7. cbse just follow the instruction released by government. previously when gov was agary for holding neet, directed cbse to arrange the neet. so cbse went to suprem court and wanted permission for holing neet in 2012 but on the same day mci and gov had filled a application for postponment of neet in 2012. so suprem court had hold the deciso for final hearing on 10 jan 2012. after that gov announced that they are not going to holding n neet in 2012 so health minister release a press note for that. and allowing every state to hold their own exam and also directed cbse to hold aipmt 2012 not neet.. marta bechara kya na karta.. cbse ne aipmt ka notification jari kar diya. par avi v uska application for holding neet in 2012 me suprem court me pending pada hua hai… ab suprem court kya karta hai ye to woqt hi batayega…

    She told me that cbse has yet not decided about the exam to be conducted in 2012…

    MUMBAI: The Medical Council of India (MCI) on Monday told the Bombay High Court that it would not implement the National Eligibility-cum-Entrance Test (NEET) for the academic year 2012-13, but would do so the following year.

    NEET is a single admission process for MBBS and post-graduate medical courses throughout the country. A division bench of Justice Dhananjay Chandrachud and Justice Amjad Sayed were hearing petitions filed by the state government, the Association of Medical Colleges (AMC) and students. They challenged MCI’s notifications of December 21, 2010 and November 11, 2011, prescribing and finalising the syllabus for NEET.

    AMC’s advocate informed the court that on December 8, 2011, the Aurangabad bench had stayed the exams. She said three other high courts (Madras, Andhra Pradesh and Karnataka) in the country have also stayed NEET. “The Aurangabad bench is of the opinion that the syllabus is based on CBSE,” she said.

    The MCI advocate submitted that NEET would be implemented not for academic year 2012-13 but for 2013-14. The judges said that in view of MCI’s statement, the students would not be under undue stress. “They will get enough time to prepare themselves,” said Justice Chandrachud.

    Advocate Ashutosh Kumbhakoni, appearing for some students, said, “If they are not implementing NEET, then the whole issue gets resolved.” He urged the court to permit DMER to proceed with preparations for holding the Common Entrance Test.

    The judges directed the MCI to put its say in an affidavit and posted the hearing for December 21.

HYDERABAD: Minister for Health DL Ravindra Reddy left for New Delhi on Saturday to clear the uncertainty over the implementation of National Eligibility cum Entrance Test (NEET) for admission into medical colleges in the state. He is scheduled to meet Union Minister for Health Gulam Nabi Azad on Sunday.

    Ravindra Reddy has gone to ascertain whether students from Andhra Pradesh would be exempted from NEET for the academic year 201213 in the wake of the Supreme Court stressing on the implementation of NEET examination from next year.

    Ravindra Reddy said that the government is pressing for exemption keeping in mind the level of preparedness of the students.

  18. The condition of present Govt. is like a prostitute. The White criminals want to anything at the cost of money. SC has fired these criminals but who cares. Halat yeh hai ki sali izzat nilam ho rahi to kya, pvt medical colleges se paise to aa rahe hain. I received SMS through which i came to know the rates in pvt medical colleges .Rates are higher by almost 4-5 lacs higher as compared to last year. The market news is that officials have been paid very high amount for cancellation of NEET. NEET is at the mercy of only APEX court. Let us see what’s happen.

NEW DELHI: The Supreme Court on Friday embarrassed the Union government and Medical Council of India (MCI) by forcing them to withdraw their pleas for one-year deferment of the first-ever National Eligibility-cum-Entrance Test (NEET) 2012, a single examination for MBBS and dental undergraduate seats in all medical colleges in the country.

    While MCI’s counsel, senior advocate Amarendra Saran, was quick to sense the mood of the court to immediately agree for an unconditional withdrawal of the regulatory body’s application, additional solicitor general Harin Raval, while agreeing to withdraw the plea by the ministry of health and family welfare, wanted recording of his statement that the government would take appropriate steps in this regard.

    This made a bench of Justices H L Dattu and C K Prasad recall that the common entrance test was formulated on the joint request of the MCI and the health ministry.

    “All these orders were passed after hearing you and you alone. The regulations have been framed by the MCI stipulating that NEET would be held from the academic year 2012-13 onwards. We will not be a party to the postponement of these regulations. If the government and the regulator want to withdraw the regulations, let them do that,” the bench said.

    Raval persisted with his request, “I want to withdraw the application but please record my statement that the government will take appropriate steps.”

    The bench shot back, “We will not record a word of it. Either you withdraw the application or we reject it. If you have other methods open to you for postponement of NEET, you are free to do that.” It went on to order dismissal of the ministry’s application but on Raval’s request, changed the order and recorded the permission to withdraw it.

    The Union government had moved the application for deferment of NEET 2012 by one year following objections by West Bengal chief minister Mamata Banerjee and other states. The test is scheduled to be held on May 13, 2012.

    One of the major reasons for the Centre moving the application was the Trinamool government’s insistence on West Bengal students being given the option of answering the test in Bengali language and some other states either seeking exemption or deferment.

    It had said, “The chief minister of West Bengal has expressed preference to continue with the Joint Entrance Examination Board for all colleges in West Bengal. However, the state would be ready to join NEET for undergraduate courses only if it is assured that Bengali language would be one of the medium for the said examination.”

    The chief ministers of Maharashtra, Assam, Andhra Pradesh and Karnataka requested the health minister for exemption from NEET 2012 on the ground that students would require some more time to switch over to the new system and get fully acquainted with the syllabus prescribed by MCI. Maharashtra, Gujarat and Goa showed readiness to join NEET from 2013-14 but AP sought exemption for two years, saying it would join from 2014-15, the health ministry had said.

    Given the myriad reasons for states not preferring NEET 2012, the health ministry said, “The government of India is of the strong view that instead of hurriedly implementing NEET from academic year 2012, it would be in the fitness of things if the same is introduced in a more planned manner from the academic year 2013-14 onwards.

  28. I think Supreme Court should have been told to visualize a situation where in they were told to study a different syllabus just before appearing for final LL.B.exam ,how they would have reacted????

    It is just ridiculous that no body wants to get in to the shoes of the state board students who are in nook and corner of the country and all are indulging in to the blame game.The students are in the final leg of their preparation of HSC board Feb./Mar.2012 followed by State CET..Creating such uncertainties at this juncture will only spoil their careers for no fault of theirs.

        According to you only CBSE students are bright as it is they whose day dreaming of grabbing seats from state board students,is going to take beating.I am not ashamed of taking state board plea as i belong to one and a hard working student.Not like you who want to grab seats by reducing competition.Incidentally,sometime back i had suggested you to start educating rural students about NEET as most of them do not even know about it.What is the progress on that????.

    केंद्र सरकार को शुक्रवार को उस समय सुप्रीम कोर्ट की नाराजगी का सामना करना पड़ा, जब सरकार की ओर से मेडिकल कोर्स एमबीबीएस-एमडी के लिए देशभर में एक साथ आयोजित की जानी वाली पहली समान्य राष्ट्रीय योग्यता प्रवेश परीक्षा को आगे बढ़ाने की मांग पर शीर्षस्थ अदालत ने असहमति जता दी। सर्वोच्च अदालत ने कहा कि सरकार इस मामले में कोई फर्क नहीं पड़ता और हम इस मामले में किसी तरह का हस्तक्षेप नहीं करने जा रहे हैं। इसलिए सरकार इस मामले में ऐसी मांग करने पर कोई निर्णय नहीं ले सकती कि समान्य प्रवेश परीक्षा को एक साल आगे 2013 तक बढ़ा दिया जाए।

    शैक्षणिक सत्र में लागू करने के लिए पेश
    जस्टिस एचएल दत्तू व जस्टिस सीके प्रसाद की पीठ ने कहा कि सरकार अपने आवेदन को वापस लेगी या फिर अदालत आवेदन को खारिज कर दे। आप जो भी चाहते हैं करिए, क्योंकि हम इस मामले में हस्तक्षेप नहीं करने जा रहे हैं। इस मामले में जो भी आदेश जारी किए गए थे वह आपके सलाह के बाद जारी किए गए थे। सरकार ने नियम और कानून से संबंधित मसौदा सामान्य प्रवेश परीक्षा को 2012-13 के शैक्षणिक सत्र में लागू करने के लिए पेश किया था। आप इस मामले में अदालत क्यों आए हैं। बेहतर यही होगा कि आप इस आवेदन को वापस ले लें।

    इस परीक्षा को आयोजित कराने से इनकार
    केंद्रीय स्वास्थ्य मंत्रालय की ओर से शीर्षस्थ अदालत में आवेदन कर प्रवेश परीक्षा को एक साल आगे बढ़ाने की मांग की गई है, क्योंकि कई राज्य सरकारों ने छात्रों के पाठ्यक्रम में अचानक बदलाव को लेकर इस परीक्षा को आयोजित कराने से इनकार कर दिया है, जबकि कुछ की ओर से शर्तें रख दी गई हैं। पश्चिम बंगाल सरकार ने कहा है कि वह इस परीक्षा को राज्य में तभी आयोजित करेगी, जब यह बांग्ला भाषा में भी कराई जाएगी। याद रहे कि सर्वोच्च अदालत ने इसी साल मार्च में केंद्र और भारतीय चिकित्सा महासंघ (एमसीआई) को यह परीक्षा आयोजित कराने की अनुमति प्रदान की थी, लेकिन केंद्र सरकार को राज्य सरकारों के अड़ियल रवैये के चलते सुप्रीम कोर्ट में आवेदन दाखिल करने पर मजबूर होना पड़ा। वहीं, एमसीआई की ओर से भी एक आवेदन सीईई और पोस्ट ग्रेजूएट कोर्स के मामले में भी दायर किया गया है। हालांकि अदालत की ओर से असहमति जताए जाने पर केंद्र और एमसीआई दोनों ने अपने आवेदन वापस ले लिया।

    • Now only one middle path is available with the Central Govt……pan-India NEET 2012 for 15 % govt quota (as a clone of AIPMT 2012) and extended NEET 2012 for 85% seats of WILLING states.
      Central govt can not afford to go against its regional allies like TMC ,DMK, etc ….

  38. In the interest of the majority of non CBSE students of all the States , the Union Government, MCI and CBSE should of think of refraining from introduction of any new system for the timebeing. They should not bring SC in the picture now.SC has permitted to conduct NEET if the Govt is ready to do so with all proper preparations in place , regulations are framed and all stake holders are agreeing to them without any ambiguity to conduct a Nation wide test.Now we are just in the beginning of framing the regulations in the fag end of the academic year.Supreme court and Union Govt should ensure that the students especially from poor family and villages are not effected by any change. regarding Medical admission statusco has to be maintained now. every effort has to be made by all concerned to iron out the differeneces in the sylabus, difference of opinion among the states , regional language issue etc etc. with in a couple of years and intoduce NEET properly without any ambiguity as per the permission given by the SC. People should refrain from confusing the students . AIPMT is already declared by CBSE and some state PMTs are also declared. Bright Students especially from the state boards are now busy in preparations of the board exam and the PMTs.Kindly do not trouble them.

    for MBBS and postgraduate admissions in the
    country looks all set to be a reality next year after
    the Centre’s attempt to defer it by a year got shot
    down by Supreme Court on Friday.
    The Court found no reason to entertain requests put
    forth by Union Health Ministry and Medical Council of
    India (MCI) to defer the National Eligibility-cum-
    Entrance Test (NEET) for under-graduate and
    postgraduate courses (also common entrance test (CET
    for MBBS courses) to 2012-13 citing practical problems. Both the Centre and MCI were heard before the Court
    had passed an order giving the green signal for NEET. Seeing the Centre’s flip-flop, the bench of Justices HL
    Dattu and CK Prasad refused to be dragged into the
    controversy. It said, “We will not be a party to
    postponement of these regulations…You better start
    preparations to implement it from 2012-13. We will
    not allow you to postpone.” The Ministry’s application read as follows: “The
    conduct of Under Graduate National Eligibility-cum-
    Entrance Test (UG-NEET) is a Herculean task which
    requires great deal of preparation and for paucity of
    time it is practically impossible to resolve the issues
    raised by various State Governments and hold the UG- NEET in 2012.” The application cited the various objections raised by
    States, for instance, Maharashtra, Gujarat and Goa
    willing to join the national test from 2013-14, Andhra
    Pradesh seeking an exemption of two years, Kerala
    demanding its reservation policies to be kept intact,
    Assam disputing with criteria for minimum marks, West Bengal for inclusion of Bengali language as a
    medium for conduct of the said examination and
    Puducherry wanting exemption from the NEET. The bench dismissed the Centre’s demand and allowed
    MCI to withdraw its application. However, the option
    of rescinding the guidelines for NEET is still open as the
    Government could still by issuing a notification
    withdraw its decision to hold a common test to enable
    lakhs of medical aspirants to apply for medical seats across the country through a single window test
    instead of appearing for 26 exams. Through the NEET,
    admissions to 15 per cent all India quota and 85 per
    cent state quota seats in MBBS courses. Earlier, the difference of views within the Government
    on this issue was evident in the SC last week when
    opposed to Health Ministry application, the Central
    Bureau of Secondary Education (CBSE) filed an
    application seeking permission to conduct the test
    from next academic year.


      You may not like it but one thing is sure NET will never happen in india because it will hamper the business of more than 1000 cr. of rupees. This will hamper the interest of broker / education mafia, white criminals etc. Money is everything for such people. Therefore, untill and unless corrupt ministers, its official exist , NEET will never happen. These people enjoy the moments while selling the coffin and abroo of their mother.

    But i think it was ministry of health and family welfare to file the affidavit..
    Plz dude check this and rectify if i m correct…!!!!
