J & K Excluded From NEET, Maharashtra’s Plea Referred to High Court

Jammu and Kashmir will not have NEET UG 2012, Board of Professional Entrance Examination will conduct the entrance test for admission to medical colleges in the state for 2012-13. (via). Maharashtra’s plea against NEET UG is passed on to the state’s high court; Supreme Court has told to Maharashtra (via) and the decision will now rest with Maharashtra’s high court in Mumbai.

However no conclusion can be drawn or there is no implied meaning that NEET UG takes place in Maharashtra; it is just that Supreme Court doesn’t want to wet it’s hands on education and state related matters.

This was evident supreme court doesn’t seem to take decisions against education controlling bodies; in the past when CBSE was challenged by students on the grounds of the paper leak issue in connection with AIEEE 2011. The apex court has said the Supreme Court doesn’t want to involve in matters related to education and entrance exams and stated the regulatory bodies have a better understanding on the situation and CBSE’s decision of not holding a retest for all AIEEE aspirants was deemed as the final judgement.

In this case supreme court neither said it will support MCI nor it declined the plea of the Maharashtra against NEET UG, the apex court stated high court should act independently and pass the judgement. So keep your fingers crosses and if you have something to share please share with us!

  1. MCI cannot declare NEET now in the month of september.How would the students prepare for the same. Its too late for their declaration. One must approach High Court against this decision.

  3. 1.In NEET – Undergraduate Medical Entrance there is a common syllabus, single exam, one result. Medical Council of India (MCI) has agreed to reserve 85% seats as State Quota when the demand raised by different stated Govts in MCI meeting.
    In West Bengal, Tamil Nadu and some other states there were District-wise reservation in middle of sixty’s decades for admission to a medical college which was struck down by Supreme Court on the ground that the object of the selection of candidate for the admission is to select the best possible talent from the entire state, having regards to efficiency required for medical profession. It is against Article 14 of Indian Constitution. Observation of Supreme Court are same for about two dozen of same type cases up to year 2011.

    So State-wise reservation of 85% NEET – UG medical seats for admission in a medical college through NEET is against Article 14 of Constitution.
    When there will be no state-wise reservation, in educationally backward states majority of seats in medical will be filled up by the brilliant students of other states. Provincialism will create a new problem. Throughout India there will be a problem of law and order.
    Article 14 in The Constitution Of India 1949 [ Equality before law The State shall not deny to any person equality before the law or the equal protection of the laws within the territory of India Prohibition of discrimination on grounds of religion, race, caste, sex or place of birth]
    2. The recent published (dated 04/11/2011) Final Syllabus by Medical Council of India for National Eligibility-cum-Entrance Test (NEET) for admission to MBBS courses across the country is not a uniform syllabus for 11th and 12th standard classes of all existing 10 + 2 Boards all over India The published syllabus for NEET in medical matches more or less 95% with CBSE 10 + 2 syllabus ; 60 – 80% matches with the others 10 + 2 boards of different states. As a result, CBSE Board students will get extra advantage in NEET-2012. It should not be encouraged that a section of examinees will get extra advantage in highly competitive exam like medical entrance.
    As per representation of MCI, the Final syllabus for NEET is of two successive years – Class XI & Class XII. Only 150 days remain for preparation of medical Entrance(s) – 2012. Higher Secondary /Equivalent Board students are going to appear/already appeared their Test exams for Final Board Exams-2012. NEET -2012 is just after final exam.
    After lesion planning it has been found that to cover the Final syllabus for NEET minimum two and half years is required.

    3. All students of science stream of 10 + 2 classes are not appear for medical entrance. The Final syllabus of NEET made by review committee constituted by MCI is in the view of medical entrance(s) only. Introduction of this syllabus only, will not be scientific for 10 + 2 curriculum.
    If it is seemed that the Final syllabus for NEET is scientific one, then other topics must be added to the curriculum for other various streams of education other than medical. As a result the length of 10 + 2 syllabus will increase. Then three years time has to give to complete 10 + 2 syllabus.

    4. How rational is it that MCI experts will decide the syllabus for 10 + 2 curriculum ? It is not fare for Central Govt. to give them charge of compiling of new syllabus.
    5. Since most of the CBSE schools are in metropolitan cities, what will be the dream / fate of rural students who are studying with state board syllabus. More metropolitan students will occupy the maximum seats in different medical colleges. Rural health system will go in danger due to lack of doctor.

      मै पूरी तरह से अक्रोशित हू मेरे अंदर गुस्सा भरा पडा हैं अगर जल्दी ही कुछ नहीं किया गया तो मैं MCI स्टाप का कत्ल कर दुंगा .

      Sir,very well said.I think if Supreme Court is presented this way,they wiil realise the mistake committed by them and put a stay on their own order giving green signal to NEET in 2012 and ask unbiased authorities to conduct NEET after making common syllabus all over the country.This will be rightly called Democracy.Conducting NEET in 2012 will be Dictatorship AND wii ruin careers of many state boaed students who are caught unawares.

    5. State ranking is maintained in NEET. Therefore, district wise reservation is not an issue as indicated above. Regarding syllabus , topics in NEET syllabus are more or less matching with state syllabus like Gujarat and Mahrastra which I have seen. Therefore, Syllabus can not be problem. Problem is being faced in previous years due to multiple exam. Therefore, NEET has become the necessity and let it happen to smooth the life of common man , poor students and non resourceful but having caliber students and will prevent similar kind of those who have manged the seats in Pvt medical colleges through “merit manipulation technique”

      The district wise reservation was struck down b’coz it was discriminatory in nature. The people of the same State are bifurcated on the basis of district demarcation which goes against the constitution. The persons inter district cannot compete in the test. Whereas here in NEET, since the State medical colleges are funded and run by the concerned State, they have the right to own 85% of the share. Also here the same State’s students can also compete for the remaining 15% thro’ all india quota. so there is no discrimination. In the case of AP and J&K, they are enjoying 100 of their quota, hence they are not allowed to share the all india quota.
      AIPMT has been happening several years with this 85 + 15 formula and SC was the one which devised that. So dont get confused, appreciate the difference. Moreover, NEET has been approved by SC after vetting all the reservations applications.

  5. KERALA A ROLE MODEL FOR PRO NEET
    At a time when some States are indulging in nit picking to scuttle the process of NEET in 2012, Kerala stands tall as a beacon supporting NEET. In all these tumultuous time, Kerala is very clear in its thinking and stands by the decision of Central Govt, Supreme Court and MCI. In India Kerala have the maximum literacy rate and whenever any rule or Act comes into force against the well being of the people, Kerala would be the first State to oppose. At the same time, if it finds the same beneficial to people, it will be the first State to welcome and adopt. In the case of NEET, it appreciates the advantages and benefits of it and had readily adopted itself for the sake of its students.

    As everyone knows, Kerala is a non-Hindi State, its official language is Malayalam, 80% of its students study State board Syllabus in Malayalam. Its State syllabus also has difference with that of core syllabus declared by MCI. It had State PMT which was set in English and Malayalam language. The so called grievances by the opposing States were all omnipresent in Kerala too. But the State was so prudent and proactive, it saw the advantages out weighing disadvantages, hence decided to take NEET.

    In my village which is hundreds of miles away from Trivandrum, the Capital city of Kerala, the public is reasonably aware about the introduction of NEET. The institute where I am studying has been informing us the possibility of NEET in 2012. About a month back, the notice about NEET was put on the campus notice board and a copy of the same was stuck in each and every class room. In my institute each and every student is aware about NEET coming in May 2012. The institute was informed by the State education board and our institute had put up the notices in the entire campus even in canteen.

    My institute had already started to adjust the curriculum according to the NEET syllabus and in fact in the last 2 weekly tests the question paper was set tougher to prepare the students for NEET. The institute had told us very clearly that students need to prepare themselves to deal the NEET questions in English only. The Malayalam papers were withdrawn from the monthly tests to begin with.

    Kerala has 23 medical colleges in all in the State. The majority of them are private medical colleges. The Kerala Govt is so transparent that without buckling to the pressure of the pvt colleges, unlike the other opposing States, supports NEET to the hilt. Gujarat which is bigger than Kerala and which has a better GDP than Kerala has only 19 medical colleges, yet a small group of parents headed by a wealthy Doctor with the connivance of vested interest is opposing NEET in Ahmedabad.

    Among all the States, Kerala definitely stands tall and majestic. In India we have 28 States and 7 Union Territories, except 5 or 6 States all other States have accepted NEET. Whether these States participate in NEET or not, it doesn’t matter, but NEET will definitely happen and we look forward to it eagerly.

    On Behalf of all these Pro NEET States and students like me hailing from villages request the opposing States to change their minds and join NEET 2012 immediately.

  6. Its quite surprising to see BJP ruled Gujarat & Karnataka which were pitching against NEET until recently are keeping silent. On the contrary, the congress ruled States Maharashtra and AP are shuttling between Supreme Court and High Court in the past 10 days or so. Karnataka appears to have softened its stand and in fact mulling about offering free coaching to its students for appearing NEET. I think it is a VERY VERY SENSIBLE AND GOOD DECISION BY THE KARNATAKA GOVT. The coaching for its State board students would ensure a level playing field in the State. Also there is a scathing criticizm in the media about the corruption in the State CET. Irregularities reported in ComedK exams have caste aspersions on the educational authorities of the State. In the light of these events, States approach of adopting to NEET is a welcome one and may prove to be a sensible solution given the circumstances.
    The other states should take the cue from Karnataka and they should also cooperate with the Centre to see through NEET in 2012. The KNEE JERK REACTIONS from AP & Maharashtra is not in the interests of the students and nation. It appears to be a prejudicial decision of these Govts to get exemption from NEET considering that these two states have maximum private medical colleges and most of them are having political connections.

    Its a BIG BIG SHAME for AP & Maharashtra to file cases against its own party Government at the Centre. They should realise that it speaks so badly about its own party before the people of India. It is time to show solidarity with the party and people and not time for in-fighting. People expect these Govts change their confrontationist attitude and be amiable and cooperative towards Centres initiative for medical reforms in the country.

      I must say that you can be a very good politician.Instead of politicizing such a sensitive issue you should try and understand(with open and unbiased mind)that what these governments are saying.None of them are against NEET but are only opposing the way it is being thrust on students without giving sufficient time to study suddenly announced syllabus which is different than the state board syllabus these students have been following since July 2010.Let us not argue that there is still time etc..Pl note that it is not only the amount of time but the mental make up also that counts when one is appearing for such an important competitive exam..
      Secondly only students who have access to internet are aware of something called NEET.Students who are not from Metro and big cities do not even know about it,forget about their preparing for it in 2012(now pl do not advise them to lose one year and appear next year).Governments should think of these students also.
      I firmly believe NEET supporters,under the guise of issue of corruption,are manipulating this situation to their benefit.They are mostly from CBSE and MCI syllabus suits them the best and hence want to grab the seats by taking advantage of confused state of state board students who are in majority.I feel manipulation is worst than corruption.
      What these governments are doing is that they are rightly supporting their students by approaching courts to request them to postpone NEET to 2013 & NOT to abandon it.If they had not done it,only CBSE students would have been successful in cracking NEET at the cost of State board students.
      Its a BIGGEST SHAME that privileged students are not considerate of unprivileged students and trying to take advantage of the situation under the pretext of corruption(as if neet will end it!!).

    1. According to MCI Statement, NEET will apply for all 335 medical colleges. J & K minister had stated that NEET will not apply in his State. No reaction from MCI. We have to wait till the amended notification is issued by the Centre and thereafter see whether it would apply to all States incl j& K. Till then, we have to keep our fingers crossed.

    Supreme court did decline Maharashtras plea.
    SC stated High Court would act independently. Not ‘State Govt’ as mentioned by you.

      I wish to tell you that in terms of law, withdrawal and decline are different terms. Withdrawal means to take back the complaint and file the petition about the same in other court. While decline, esp. here, by SC means that NO OTHER COURT CAN GIVE A JUDGEMENT. I hope you get my point clearly.

Hi I am also keenly following news with you all; we don’t even attempt to contact MCI since they are very firm about their decision of conducting NEET UG in May 2012 in other words they too have no idea on which states will participate; but they have made it clear, J&K and Tamilnadu are freed. Seriously it all depends on the State and the power they have to manipulate or convince MCI. NEET may be deferred by 1 year in few states but Hindi speaking states mayn’t stand a chance to escape from NEET UG 2012.

      P.S: Sincerely these are only my views and speculation.

        Can you elaborate a bit. Where did MCI say this statement?

        According to my knowledge, based on my personal dialogue with an MCI official, the new notification which the Central Govt is expected to release will supersede the stay order of Tamilnadu obtained on the 2010 notification. Earlier, Madras High Court gave the stay based on the fact that the earlier 2010 notification was not approved by the Central Govt at that time.

        Besides, Jayalalitha had sent a letter in Aug 2011 to the Prime Minister asking for exemption from NEET. IF Tamilnadu is exempted legally then why she should send this communication. You see there is no need for her to send this communique. Also during her recent visit to Delhi, she had requested the Centre to exempt Tamilnadu. This implies that the State is not automatically exempted.

        For J&K, we have to wait and see what happens to this State after the notification is issued. However, absence of J& K does not make much impact in view of very few seats in that state.

Hi Dinesh, MCI never said anything officially neither they say now about J&K, Tamilnadu but as per the information we got from genuine news sources (like TOI, DC, Hindu) we have put those statements. Till date even MCI hasn’t announced that it will conduct NEET UG in May 2012 (You will not find it anywhere on MCI website); if you can take this for granted probably you have to agree with other facts also, TN will not allow for a common medical entrance test in it’s state if the test is skewed to benefit students from English medium and CBSE schools. What about Tamil medium students, the state gives highest priority to it’s regional language, no where they write in English you don’t find English names even on Buses.

          I am asking as a student if I had studied in a regional medium school say in Tamil right from my schooling now if someone says dude you got to learn English and appear for NEET, don’t you think I am at a disadvantage over other guys who had the benefit or luxury of going to English medium schools. If we are talking of right to education in our country probably it’s time we give value to even the under privileged and lower middle class students, don’t they deserve white collar jobs.

          P.S: Where ever we mention news we always cite the proper source of information, MCI hardly updates anything on it’s website 🙂

            In fact, if you see VISION 2015, it did mention that the test will be offered in Tamil and few other vernacular languages. This issue continues to be dicey and MCI keeps rolling the ball between itself and CBSE, the exam conductor.
            About the exam date of May 13, some news reports stated that MCI Secretary had issued a Statement to that effect, though it was not published in MCI’s web site.

          2. If tamilnadu student can not write NEET-UG in English , then how can those student study the whole course MBBS in English? MCI Should not allow anybody to escape from NEET with the language basis.How tamilnadu student are writing the AIEEE and IIT exams and other National level exams?

            1. Your points well taken John, but the main Villains in this language turmoil are the States. To my knowledge, almost all States kept sleeping on NEET, though these States were well aware about its implementation and they were actually party to this NEET concept. Most of the students were not aware what was coming and were neither informed by these States and their education depts. In Tamilnadu, majority of the students being from State board with tamil medium, it becomes difficult for them to suddenly switch over to answering in english. So, the benefit of doubt should be given to these students by providing vernacular test atleast for 1 or 2 years in the beginning of NEET.

  18. NO DOUBT NOW THAT NEET WILL BE TAKING PLACE . EVEN IF THESE 5-6 STATES ARE EXEMPTED THEN ALSO NEET WILL BE A GO. BUT THE QUESTION IS WHETHER THESE STATES WILL BE GIVING THEIR 15% SEATS OR NOT.
